Ten Questions to Ask a Divorce Attorney
These questions can help you evaluate whether an attorney is the right fit for your needs and your case.
Do you focus primarily on divorce and family law, or is it only part of your practice? How long have you practiced family law, and approximately how many cases have you handled? Are you a certified family law specialist?
What is your general approach or strategy for my case? Based on your experience, what is a realistic timeline for resolution?
How accessible are you? How quickly do you typically return calls or emails? What qualifies as an emergency, and how should I reach you if one arises?
Who else will be involved in my case? Will associates, paralegals, or other staff members work on my file? How much of my case will they be responsible for?
How are fees structured? What is your hourly rate? Do you bill for time spent by other attorneys, paralegals, or administrative staff, and at what rates? What retainer is required upfront?
What additional costs should I expect? Are there outside professionals you anticipate using, such as forensic accountants, private investigators, medical professionals, or mental health experts? How are those costs handled?
Can you give a general estimate of the total cost of my divorce? While most attorneys cannot provide an exact figure due to variables like conflict level, how they answer this question can be telling. Be cautious of unrealistically low estimates.
How can I help keep legal costs manageable? Will I be allowed to negotiate directly with my spouse when appropriate? Are there tasks I can handle on my own to reduce billable time?
Based on your experience, how might a judge view my case? What outcomes are realistic if the case were to go to court?
How will you help me understand the tax implications of my decisions? What resources or guidance do you provide to ensure I’m informed about potential financial consequences?
